TERMS & CONDITIONS

Welcome to Javan Entertainment ("Javan Entertainment," "we," "us," or "our"). These Terms & Conditions govern the use of www.JavanEntertainment.com and all DJ, MC, lighting, uplighting, photo booth, live percussion, special effects, and related entertainment services provided by Javan Entertainment.

By booking services, signing an agreement, submitting payment, or allowing services to proceed, you ("Client") agree to these Terms & Conditions. If you do not agree, please do not use our services.

SECTION 1 – BOOKING & AGREEMENT

All services are provided pursuant to a signed Service Agreement ("Agreement"), which incorporates these Terms & Conditions.

A booking is confirmed only when:

A signed Agreement has been received; and
The required non-refundable retainer has been paid.

Until both requirements have been satisfied, the event date remains available to other clients.

SECTION 2 – FEES & PAYMENT TERMS

All fees shall be as stated in the Agreement.

The non-refundable retainer secures the event date and compensates Javan Entertainment for reserving the date and declining other bookings.

The remaining balance shall be due as specified in the Agreement. Failure to make payment when due may result in cancellation of services without refund of the retainer.

Accepted payment methods may include cash, check, Zelle, credit card, debit card, Apple Pay, or approved electronic invoicing.

Client agrees not to initiate chargebacks or payment disputes without first providing Javan Entertainment an opportunity to resolve the matter. Unauthorized chargebacks may result in collection efforts and recovery of applicable fees and costs as permitted by law.

SECTION 3 – CANCELLATION

All cancellations must be submitted in writing.

Retainers are non-refundable except as specifically stated in the Agreement.

Any cancellation fees, damages, or refund provisions shall be governed by the signed Agreement.

SECTION 4 – OVERTIME

Performance concludes at the contracted end time.

Additional performance time must be approved and paid for in advance and will be billed at the rate specified in the Agreement.

Without prior approval and payment, services will end at the scheduled completion time.

SECTION 5 – VENUE & SETUP REQUIREMENTS

Client shall provide:

• A safe and suitable performance area
• Reliable electrical power
• Adequate setup and breakdown access
• Protection from weather for outdoor events
• Any venue-required permits or approvals

Failure to provide suitable conditions may result in delayed, suspended, or terminated services without refund.

Javan Entertainment shall not be responsible for venue restrictions, curfews, sound ordinances, power limitations, or actions of venue personnel.

SECTION 6 – GUEST CONDUCT & SAFETY

Client assumes responsibility for the conduct of all guests and attendees.

Javan Entertainment reserves the right to suspend or terminate services if equipment is threatened, damaged, or if conditions become unsafe.

No refund shall be provided if services are interrupted due to unsafe conditions caused by guests or third parties.

SECTION 7 – FORCE MAJEURE

Javan Entertainment shall not be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to illness, accident, severe weather, natural disasters, government action, transportation interruptions, or other unforeseen events.

If reasonably possible, we will attempt to secure a qualified replacement entertainer.

SECTION 8 – MEDIA RELEASE

Unless otherwise requested in writing prior to the event, Client grants Javan Entertainment permission to use photographs, videos, reviews, and testimonials for marketing, advertising, social media, and promotional purposes.

SECTION 9 – LIMITATION OF LIABILITY

Javan Entertainment shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from any service provided.

Maximum liability shall not exceed the total amount paid by Client under the Agreement.

SECTION 10 – NO GUARANTEE OF RESULTS

Entertainment is inherently subjective.

While Javan Entertainment strives to provide exceptional service, no guarantee is made regarding guest participation, crowd response, event atmosphere, or specific entertainment outcomes.

SECTION 11 – GOVERNING LAW

The laws of the State of Texas shall govern these Terms & Conditions and all Agreements.

SECTION 12 – SEVERABILITY

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 13 – ENTIRE AGREEMENT

The signed Agreement, together with these Terms & Conditions, constitutes the entire agreement between the parties and supersedes all prior discussions, representations, or understandings.

SECTION 14 – MUSIC SELECTION & REQUESTS

Client is responsible for providing music preferences, special requests, and "Do Not Play" lists prior to the event.

While reasonable efforts will be made to accommodate requests, Javan Entertainment retains professional discretion regarding music programming, song selection, and event flow.

SECTION 15 – EQUIPMENT & TECHNICAL ISSUES

Professional-grade equipment and backup systems are utilized whenever reasonably available.

In the unlikely event of equipment failure or technical issues beyond our reasonable control, liability shall be limited to a prorated amount of the affected services.

SECTION 16 – EVENT DELAYS

Javan Entertainment shall not be responsible for delays caused by the Client, guests, venue staff, venue operations, or third-party vendors.

Delays do not automatically extend contracted performance times.

Additional performance time requested due to delays may be subject to overtime charges.

SECTION 17 – MEALS & BREAKS

For events exceeding four (4) hours, Client agrees to provide a reasonable meal and break accommodation for the DJ and any supporting staff, unless otherwise agreed in writing.

SECTION 18 – EVENT CONDITIONS

Client acknowledges that venue conditions, guest participation, weather, lighting conditions, venue layout, and other factors beyond our control may impact the overall event experience.

SECTION 19 – TRAVEL & DESTINATION EVENTS

Events outside the standard service area may require additional travel-related fees including transportation, lodging, parking, tolls, and related expenses as outlined in the Agreement.

SECTION 20 – ACCESS, LOAD-IN & PARKING

Client shall ensure reasonable access for equipment loading, setup, breakdown, and removal.

Any parking fees, valet charges, permits, venue access fees, or related costs shall be the responsibility of the Client unless otherwise agreed in writing.

SECTION 21 – POWER & VENUE FAILURE

Javan Entertainment shall not be responsible for interruptions caused by power outages, venue equipment failures, internet outages, or circumstances beyond our control.

SECTION 22 – ADD-ON SERVICES

Additional services including uplighting, photo booth services, live percussion, special effects, and other enhancements are subject to venue approval, safety requirements, and space availability.

Venue restrictions preventing the use of add-on services shall not constitute a breach of this Agreement.

SECTION 23 – ACCEPTANCE

Booking services, signing an Agreement, submitting payment, or permitting services to proceed constitutes full acceptance of these Terms & Conditions.
